Investigation facts!

HMRC can at any time inspect business documents and assets at the business premises. They can ask for documents as well as any information they feel is relevant and make unannounced inspections. They can also go back up to 20 years to investigate any findings or issues they are concerned about. HMRC do not have to have a specific reason to launch a tax investigation, this means that anyone that submits a tax return is open for investigation.

What triggers an investigation? HMRC claims compliance checks usually get triggered when the figures submitted on a tax return appear to be wrong in someway and raise a flag. This can be a simple error.

We believe you have done nothing wrong!

With the majority of tax enquiries being generated by HMRC’s computer “risk profiling” as well as many being selected completely at random. It happens that HMRC sometimes pick the wrong targets and you could get selected. If you have done nothing wrong it can happen and the role of the taxman is still to try and find any errors.  This is where having a good accountant is a real godsend.

Code Of Practice 8

At the more serious end of the scale, HMRC can open enquires under either COP (code of practice) 8 or 9. COP 8 is used by HMRC where they suspect that a significant amount of tax is at stake, but fraud is not suspected. At this point, the quality of the disclosure made to HMRC can dramatically reduce any penalties.

Code Of Practice 9

Under COP 9, HMRC suspect that tax fraud has been committed. HMRC prefer to deal with such cases under the Contractual Disclosure Facility, which provides you with the opportunity to make a full disclosure, with the trade off being that HMRC will not prosecute.
